ASPIRE POLY FURNITURE: TERMS AND CONDITIONS

Welcome to Aspire Poly Furniture. This website (the "Site") is owned and operated by Aspire Poly Furniture ("Company," "we," "us," or "our"). By accessing, browsing, or using this Site, or by purchasing any products from us, you ("Customer," "buyer," "user," or "you") explicitly agree to be bound by the following Terms and Conditions ("Terms").
PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING A MANDATORY ARBITRATION CLAUSE AND A WAIVER OF CLASS ACTION RIGHTS.
If you do not agree to these Terms in their entirety, you are not authorized to use this Site or purchase our products.

1. Incorporation of Supplemental Policies
These Terms and Conditions constitute the entire legal agreement between you and Aspire Poly Furniture. Any standalone references on our Site to shipping timelines, delivery protocols, or product care are explicitly governed and overridden by this master contract.
2. Website Eligibility and Security
  • Age Requirement: By using this Site, you represent and warrant that you are at least eighteen (18) years of age or the legal age of majority in your jurisdiction.
  • Account Security: If you create an account on our Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We reserve the right to terminate accounts or refuse service at our sole discretion.
3. Binding Order Process and Production Lead Times
  • Offer and Acceptance: The presentation of products on this Site does not constitute a legally binding offer, but rather an invitation to order. Completing the checkout process constitutes a binding offer to purchase goods. Aspire Poly Furniture reserves the right to decline or cancel any order due to pricing errors, material shortages, or suspected fraud.
  • Standard Production Lead Times: All products are custom built-to-order. By placing an order, you accept our standard production lead time of four (4) to six (6) weeks. This timeframe represents factory manufacturing, precision cutting, and hand assembly only; it completely excludes carrier transit time.
  • Seasonal Delays: Delays caused by peak seasonal demand, material supply disruptions, or holidays do not entitle the customer to discounts, cancellations, or refunds.
  • Immediate Financial Capture: Full payment—including product costs, sales taxes, and freight fees—is processed and captured immediately at checkout. Production begins only after payment successfully clears.
4. Shipping, Curbside LTL Freight, and Delivery Obligations
  • Carrier Discretion: Aspire Poly Furniture reserves the absolute right to determine the most efficient shipping method. Large orders exceed standard parcel limits and will ship via Less-Than-Truckload (LTL) Freight on pallets; smaller orders will ship via standard parcel networks in individual boxes.
  • Strict Curbside Delivery Limits: All LTL freight shipments are strictly Curbside Delivery Only. The carrier will drop the pallet at the curb or edge of the driveway via a liftgate. Delivery personnel are explicitly unauthorized to bring items into a home, garage, porch, or backyard, nor will they assist with unboxing or debris removal.
  • Property Accessibility: It is your absolute responsibility to ensure the delivery address is entirely accessible to a full-sized commercial freight truck (up to a 53-foot semi-truck).
  • Missed Appointments and Fees: For LTL shipments, the carrier will contact you to schedule a mandatory delivery window. A legally responsible adult (18+) must be present. Failure to meet the carrier, providing an invalid phone number, or refusing a valid delivery results in redelivery fees ($100–$250+), daily carrier storage fees ($50–$150/day), or return freight charges billed entirely to the Customer's payment method on file.
  • Porch Piracy Disclaimer: For small items shipped in individual boxes via standard parcel carriers, no signature is required. Aspire Poly Furniture is not responsible for packages stolen or damaged after a verified successful delivery scan by the carrier.
5. Final Sale and Strict No-Return Policy
  • Strict No-Return Policy: All sales are final. Because products are custom built-to-order, Aspire Poly Furniture enforces a strict No Returns, No Refunds, and No Exchanges policy once an order has been submitted.
  • Exclusion of Buyer’s Remorse: We do not accept returns or issue credits for reasons relating to buyer's remorse, subjective color preference variations, site measurement miscalculations, or changes in personal circumstances. It is the sole responsibility of the customer to verify all product dimensions and specifications prior to completing checkout.
6. Absolute Restriction on Order Cancellations
  • Immediate Production Queue: Because our manufacturing process begins immediately upon order confirmation—including automated material allocation and labor routing—orders cannot be canceled or altered by the customer after submission.
  • Discretionary Pre-Production Cancellations: In the highly exceptional event that Aspire Poly Furniture, at its sole discretion, approves an order cancellation request prior to physical manufacturing, the cancellation will be subject to a non-negotiable 20% administrative and material restocking fee deducted directly from any issued credit. No cancellation requests will be reviewed or honored once physical manufacturing has commenced.
7. Damaged, Defective, or Missing Items Protocol
  • Mandatory Delivery Inspection: Customers must physically inspect all pallets, packaging, and visible components before signing the carrier's delivery receipt or Bill of Lading (BOL).
  • Notating Damage on the BOL: Any physical damage to the packaging or furniture must be explicitly and clearly noted on the carrier's BOL before the driver leaves. Leaving the BOL blank or writing "subject to inspection" completely voids your ability to claim transit damage.
  • Reporting Window: Damage, structural defects, or missing items must be submitted to Aspire Poly Furniture in writing with high-resolution photographic evidence within forty-eight (48) hours of delivery. Failure to report within this window constitutes an absolute waiver of your claim.
  • Sole Discretionary Remedy: If a claim is validated, Aspire Poly Furniture reserves the sole, exclusive right to either repair the item, send replacement parts, or replace the entire unit at our absolute discretion. Transit damage does not justify a return, refund, or order cancellation.
  • Unauthorized Returns: Any unauthorized shipments sent back to our facility without an official written Return Merchandise Authorization (RMA) will be summarily refused, and all associated freight and storage fees will be billed entirely to the customer.
8. Product Warranties and Limitation of Liability
  • Manufacturer Warranties: Aspire Poly Furniture serves as an authorized retailer and distributor of premium outdoor furnishings. Products sold on this Site are covered exclusively by the explicit, written structural and performance warranties provided by their respective manufacturers (including specific commercial or residential warranties against rotting, splitting, cracking, or fading).
  • Warranty Documentation: Warranty terms, durations, and claim protocols vary by individual product and manufacturer. It is the Customer’s responsibility to review the specific warranty documentation associated with each product tier prior to purchase. Aspire Poly Furniture will assist the Customer in facilitating valid warranty claims with the manufacturer, but the manufacturer remains the sole underwriter of said warranty.
  • Disclaimer of Implied Warranties: EXCEPT FOR THE EXPLICIT WRITTEN MANUFACTURER WARRANTIES ASSIGNED TO EACH INDIVIDUAL PRODUCT, ASPIRE POLY FURNITURE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. THIS INCLUDES, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, DURABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
  • Limitation of Liability: IN NO EVENT SHALL ASPIRE POLY FURNITURE, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, OR LOSS OF BUSINESS PROFITS ARISING OUT OF THE SELECTION, ARRIVAL, ARRANGEMENT, OR USE OF THE PRODUCTS.
  • Liability Cap: OUR MAXIMUM AGGREGATE LIABILITY FOR ANY VALID CLAIM, DISPUTE, OR BREACH ARISING OUT OF A PURCHASE SHALL NEVER EXCEED THE ACTUAL NET PURCHASE PRICE PAID BY THE CUSTOMER FOR THE SPECIFIC ITEM PRODUCING THE LIABILITY.
9. Manufacturing Variations
  • Material Disclaimers: Our poly furniture is manufactured utilizing high-density polyethylene (HDPE) recycled plastics. You acknowledge that minor variations in color tones, grain patterns, and surface textures are standard, natural characteristics of the recycling and manufacturing process. These unique variations do not constitute defects or errors in ordering specifications.
10. Intellectual Property Rights
All content included on this Site—including but not limited to text, graphics, logos, product designs, imagery, digital downloads, and software—is the exclusive property of Aspire Poly Furniture and is protected by United States and international intellectual property laws. You may not copy, reproduce, or commercially exploit any website assets without our express, prior written consent.
11. Fraudulent Chargebacks and Indemnification
  • Chargeback Prohibition: By finalizing a purchase, you agree to resolve disputes through the channels detailed in Section 12. Filing a credit card chargeback or merchant dispute due to buyer's remorse, carrier delays, or a refusal to follow the damage protocol constitutes a breach of contract. Aspire Poly Furniture will aggressively defend its policies by providing this signed contract to banking institutions.
  • Indemnification: You agree to defend, indemnify, and hold harmless Aspire Poly Furniture from any claims, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or misuse of our products.
12. Dispute Resolution: Mandatory Arbitration & Class Action Waiver
  • Good Faith Negotiation: If a dispute arises, both parties agree to first attempt an informal resolution via written negotiation within thirty (30) days.
  • Binding Arbitration: If unresolved, the dispute shall be settled exclusively through binding, individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will take place in the home county of Aspire Poly Furniture’s registered business location. The arbitrator's ruling shall be final and binding.
  • Class Action Waiver: PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS. YOU EXPLICITLY WAIVE THE RIGHT TO ACT AS A CLASS REPRESENTATIVE OR PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS IN ANY LAWSUIT OR ARBITRATION AGAINST US.
13. Governing Law and Severability
  • Governing Law: These Terms, your use of the Site, and all transactions executed through it shall be governed by the laws of the State in which Aspire Poly Furniture is legally registered, without regard to conflict of law principles.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court or arbitrator, that specific provision shall be severed. The remaining provisions will continue in full force and effect.
14. Modifications to Terms of Service
Aspire Poly Furniture reserves the right to update, alter, or replace any part of these Terms and Conditions at any time by posting updates to our Site. Your continued use of the Site following updates constitutes absolute acceptance of those modifications.
